What is a “Pour-Over Will?”

By Phil Craig One of key parts of your estate plan is your “pour-over will.” Yet, many people don’t know what it is, what it does, or why it is needed. First, what is a “pour-over will?” Simply put, it is a last will and testament that states that if there is an asset that was left out of your revocable living trust, then the missing asset is to be put (”poured over”) into your revocable living trust so that the missing asset will be transferred along with the other assets of your revocable living trust. Another purpose of your pour-over will is to revoke any prior wills you might have had. This avoids the possibility of a conflict between what is stated in your revocable living trust and what was stated in your prior will. The pour-over will can also state your wishes with regard to who will care for any minor children you might leave behind. This is called nominating a “guardian of the person” of your children. Your revocable living trust will probably contain provisions for the use of your assets for your minor children. Does a “pour-over” will require probate? Yes. Probate is used to carry out the terms of your will. A will has no effect unless and until it is admitted to probate. Often, we will not need to use the pour-over will to avoid probate if we have a General Assignment of Assets to our revocable living trust. Marketing Plans: Better Simple Than Not Followed

By Mick Danskin For all the marketing professionals, brilliant salespeople, crafty entrepreneurs, and self-proclaimed marketing wizards I’ve come across, very few of them have shown any prowess in developing, and certainly little in applying a sound marketing communications plan. It isn’t easy, but it’s really not that hard, either. It takes some insight and serious persistence. But, even more important than that is simplicity. Why? If a plan is too intricate or difficult to communicate, it likely won’t be implemented. Don’t fret, though. I’m here to help. I’ve developed a plan for which the acronym is IMPACT, which you can find in action at www.danskincreative.com. But, I’ll use simplified language here, to get in the spirit of the title of this post. Anyway, here are the steps required: Research: Use whatever is at your disposal (available studies; field sales reps; key customers; competitors; or focus groups if you sell direct to consumer) to determine where your company/products are positioned in the marketplace, existing perceptions, strengths and weaknesses, opportunities and threats (SWOT), successful marketing initiatives of the past (what worked? what didn’t? and why?) how you stack up against competition, etc. Insights: Next, from cross-referencing this information with your company’s business objectives (see: All About The Business Objectives) you will be able to identify key insights, which are opportunities that will motivate specific marketing action. Make a list of these and you’re on to your next step. Plan: This is where you outline the marketing initiatives that integrate to address insights from the prior step. This might sound easy. It really is not. Not really. This is where the real marcomm strategy comes into play. This is where many companies call in marcomm firms like Danskin Creative Communication, Inc. (even though we’d prefer to be involved earlier). Investment: We don’t need to tell you to be precise wherever possible when developing the real investment that you will have to sell up the ladder. If not, the “apologize later” mentality is sure to launch you into a new career, or send you hobbling back to a cubicle. Create: You know the strategy, the business objectives, and the market realities. Next comes the fun part. You get to implement the plan and execute the well-conceived marketing initiatives: the brilliant advertising, graphic design, brand development, public relations, etc. Make sure you do it well! Measure: This is an ongoing process and very impressive to show the C-levels what/how you will report to them. Plus, you can show them what metrics you’ll use to ensure that adjustments will be made in a timely manner if particular initiatives are not succeeding. This is also a great place to discuss how the marketing communication plan is alive and breathing. Remember, keep it simple and don’t fall victim to detours. Once your plan is approved by the c-level, use that leverage to stay on message and track. Even have them sign a hard copy if that makes the point. The Struggle To Socialise For People Who Stammer

By Steve Hill If at times you find going out and socialising a bit of a choir, spare a thought for people who suffer with a stammer. Stammering is a much wider problem than many people care to imagine and the affects of having a stammer can be very damaging. Most people who stammer would love to have the confidence and overall fluency to speak much more than they actually do in reality. Take for example a social situation where the person who has the speech impediment has been invited to the local pub to spend a Friday night out with his friends. Firstly if this evening has been planned for a number of days the stammerer will more than likely have been worrying about this night for some time, possibly even losing out on some important sleep. This is because people who stammer can at times find it quite difficult to socialise. During the evening itself one his/her friends may ask him/her, how their week has been. The person who has the stammer has plenty that they would like to say and may have some very interesting news/stories to tell, but more often than not will simply reply with a one word answer such as OK. This can make the stammerer look like quite a dim, boring or shy person where in reality they just did not have the self-belief to say anymore. The person who has the stammer is left feeling really awkward and full of guilt as they know that they should have said far more than what they did. At the end of the day there is no real point in going out with friends if you are not going to converse in a proper way and for this reason many people who stammer like to stay in and will tend to decline many social offers. That is not to say that they are happy to stay in but that they feel that this is there only option or best option at least. It is not of course just the general chit chat with friends that is the problem for people who stammer, when they go out to socialise with their friends. Having to order food and drinks can fill many people who stammer with dread, meeting new people such as the friends of a friend, can be very difficult. These new people that are introduced tend to ask lots of questions such as where do you work? Many people who stammer hate being asked these types of direct question as they feel like they have been put on the spot and it also makes them feel very much under pressure. The more pressure, the more likely it is the stammer will rear its ugly head. Another example would be a person who has a stammer who goes to play football with his friends, I will call him John. John loves to play football and always talks very well during the game as he feels like he is in his element and is very relaxed. After the game most of the players go for a few drinks at the local bar, John however decides that this is not really for him and goes home. This is a typical situation where a person feels comfortable and able to speak fluently in situation A but feels that situation B will probably result in them stammering as it is a totally different social situation. John in this example feels that he knows what he is and isn’t able to cope with in his social life. He is happy to play football but refrains from the football chat that happens in the bar afterwards. Homeschooling Information

By Mary Green Yesterday a friend stopped by and got me all excited about homeschooling again. We were talking about different ways of homeschooling, and then I realized that I hadn’t posted much about homeschooling on the blog. We talked about Un-schooling- the new way to not teach. There is supposedly no syllabus, and no particular direction in which to teach your kids. You go with their interests, and follow where the interests leads. An example would be for kids who are interested in cats, so you take them to the humane society. From there they want to know more about kittens, where they come from maybe, so you take them to the vet to ask questions. Then at the vets the kid learns you can only keep so many animals, so you go to the city court to see the laws behind having pets. Another way is through note booking, which I do not know much about, except you write down everything that pertains to the subject in one notebook. A nice one we discussed was unit teaching, which is done with up to a few kids of different ages, and based on what the kids are suppose to learn you teach subjects like Egypt, the history, the culture, the geography, science of the area, and more. I really like the idea of going by a specific syllabus for each child, that would involve Christianity, morals, principles, math, science, social studies, cooking, and whatever else I can come up with. Not all at once but over time. I am not sure if I will ever come up with such a curriculum, but I am looking. Every book is full of promises that this will be the only diet book you’ll ever need, the answer to your prayers. But there you are again, just a few weeks or months later buying another diet book, hoping that this one has the true magic formula that will help you lose weight and stay slim forever. But actually there is no magic formula in any of those books, there never will be. You are the only one that has the magic formula - the desire, the determination and the ability to take action. Many of those diet books would work if you could bring yourself to follow the “easy” food plans in them. Many of the exercise programs would tone and slim your body if you could drag yourself to the gym to do the routines or even get yourself out of bed in the morning early enough for a toning session at home. Success does not have to happen in a day. But making small changes one after the other brings about huge success. It gives you the chance to adapt bit by bit to a healthier lifestyle. On the other hand, if the lifestyles in the books do not appeal as a way of living forever then that’s another story. Diet books generally offer a quick fix rather than an attractive way of life (quick fixes are what give us the hope and sell the book after all). In that case, why not design your own healthier lifestyle - one you’re prepared to live with forever and put that in place step by step? Relieve Pain With Foam

By J Bocobo The back of the neck, shoulders, low back, hip(s), knees, ankles and heels. What do they have in common? They are the places on our bodies that most often have aches or pains. A common source of pain can be muscle tightness brought on by overuse, or in some cases under use. Things like driving, working at a computer, standing in line, sleeping on your side or any number of everyday activities can create the conditions for tight muscles. The affected areas typically develop knots that can alter a muscles optimal length and disrupt how you normally move. When this happens, everyday movements can become labored and painful. The knots must be released so that muscles can relax and return to their normal functioning length. One possible answer to your prayers could be a simple foam roller. This unassuming device is used to perform a flexibility technique called self-myofascial release or foam rolling. Simply put, you use it to relax tight muscles and feel better. Self-myofascial release works by applying pressure to muscles with a foam roller. A mechanism in your muscles senses the pressure. Your body then sends a signal back to the knotted muscle telling it to relax. Some muscles will relax immediately, while others will need repeated treatment. Bear in mind that the tenderness experienced when putting pressure on knotted muscles can be mild to severe. Do not let this be a deterrent to potentially liberating yourself from learn to live with it pain. If you are persistent and consistent you will begin to see results. Something else to consider once youve relaxed knotted muscles are the things you do throughout your day that might have caused your pain in the first place. Unless you change those movement patterns, muscle pain will continue to harass you. The easiest thing you can do is give yourself frequent breaks from things like working at a computer, carrying a bag/backpack a certain way, or doing a particular exercise for weeks or months on end. Instructions for foam rolling are as follows: Roll slowly (1 per second) over muscles. Do not roll on joints. If you find a tender area or knot hold for 20-30 seconds or until tenderness subsides by 50%, then move on. Take deep breaths while holding on a knot and let yourself relax. If the knot is too intense move on and come back to it later. Self-myofascial release may be performed daily. Use of this technique is not recommended for diabetic individuals who have lost the protective sensation in the lower limbs. It is also not suggested for anyone during pregnancy or who has hypertension, coronary heart disease, intermittent claudication/peripheral arterial disease, and osteoporosis.
